The LAC’s Supreme Court and First and Tenth Circuit amicus briefs argued against retroactive application of the amended reinstatement statute. Our Ninth Circuit En Banc amicus brief argued that the current reinstatement regulation is invalid. The regulation permits low-level immigration officials who are untrained in the intricacies of immigration law to reinstate a prior order.
